All contracts of sale incorporate these conditions so far as such conditions are not varied by any special terms or conditions agreed in writing between the parties and any terms and conditions in the Buyer's order which are inconsistent with these conditions shall have on effect. Any variation of the contract will become binding if confirmation is given in writing by the parties.
The ownership of the goods shall not pass to the Buyer until payment in full for the same has been received by the Seller. Risk in the goods shall pass to the buyer upon delivery or collection (including third party) thereof. If not withstanding the foregoing the Buyer is in default of payment of any part of the purchase price or shall before the whole of the purchase price has been paid have a receiving order made against him or being a company go into liquidation or have a receiver appointed, then the Seller may without prejudice to any other rights or remedies available to him be entitled to recover possession of the goods and sell the same retaining all monies raised on account of the purchase price and accounting to the Buyer for the balance if any.
Any price quoted by the Seller or comprised in the order or contract is provisional only and will be varied according to the Seller's scale of prices at the date of dispatch of goods or of each consignment thereof. Each part delivery or instalment of the goods will be deemed to be sold under a separate contract.
All quotations are subject to availability of goods and expire after 7 days. We reserve the right to withdraw or amend any quotation based on the availability or condition of stock. Eg. If we find we have damaged stock that is not saleable we reserve the right to withdraw this item from sale/quotation or offer an alternate item.
Acceptance of all orders and contracts is subject to the availability of the goods specified and all offers are made without engagement regarding delivery.
Goods represented by the Buyer to be defective shall not form the subject of any claim for work done by the Buyer or for any loss, damage or expense whatsoever arising directly or indirectly from such defects, but such goods, if returned within seven days to the Seller and accepted by him as defective will at the request of the Buyer and if practicable be replaced as originally ordered. Defects in quality or dimensions in any delivery shall not be grounds for cancellation of the remainder of the order or contract. No claims for damage, loss or partial loss can be accepted unless written notice is received within three days of delivery.
Goods which are not deemed by the seller to be defective will only be accepted at the sellers discretion and we retain the right to charge a restocking fee of 20%. Customers are fully liable for all items they order.
Unless otherwise expressly stated in the contract, the price of the goods (including freight and other charges) shall be paid in full and received by the Seller before delivery of the goods. The seller shall be entitled to charge interest on any sums not so paid. Such interest shall be calculated on the amount outstanding at the rate of 2% above the minimum lending rate of Lloyds Bank Ltd.
All new goods are subject to manufacturer's guarantees only. Reconditioned and second hand goods cannot be guaranteed.
All new furniture is subject to manufacturer's "Condition of Sale" which states that manufacturers can change prices, construction and sizes without notification of the Buyer.
